Opłata sądowa w wysokości 5 mln zł ogranicza dostęp do sądu – orzekł 15 kwietnia 2014 roku Trybunał Konstytucyjny uznając za niekonstytucyjny przepis dotyczący skargi w sprawach przetargowych ( sygn. akt SK 12/14).
Skarga konstytucyjna dotyczyła art. 34 ust. 2 ustawy o kosztach sądowych w sprawach cywilnych (t.j. Dz.U. z 2010 r., nr 90, poz. 594 ze zm.). Zgodnie z tym przepisem od skargi na wyrok Krajowej Izby Odwoławczej dotyczący czynności podjętych po otwarciu ofert w przetargu pobiera się opłatę stosunkową w wysokości 5 proc. wartości zamówienia, jednak nie więcej niż 5 mln zł.
W praktyce oznacza to, że jeśli zamówienie ma wartość 10 mln zł, to firma, która chce zaskarżyć wyrok KIO, musi zapłacić 500 tys. zł. Jeśli przetarg dotyczy 100 mln zł, to w grę wchodzi już kwota 5 mln zł.
Tak też stało się w przetargu, którego dotyczyła skarga. Ponieważ wartość zamówienia wynosiła 182 mln zł, sąd zażądał maksymalnej opłaty czyli 5 mln zł.
TK zajmował się kontrowersyjnym przepisem nie po raz pierwszy. Przed trzema miesiącami badał dwie połączone sprawy dotyczące tej samej opłaty. Z przyczyn formalnych kluczową część postępowania umorzył (sygn. akt SK 25/11) – doszedł bowiem do wniosku, że zaskarżony przepis należy rozbić na dwie normy prawne: jedną dotyczącą opłaty stosunkowej (czyli 5 proc. wartości zamówienia) i drugą dotyczącą maksymalnej opłaty (czyli 5 mln zł). Pierwszą normę uznał za w pełni konstytucyjną, a w sprawie drugiej postępowanie umorzył. Stało się tak dlatego, że żaden ze skarżących przedsiębiorców w swych sprawach nie musiał uiszczać maksymalnej opłaty w wysokości 5 mln zł.
Mówiąc wprost, TK nie wypowiedział się w ogóle co do tego, czy opłata przekraczająca 100 tys. zł nie ogranicza w nadmierny sposób dostępności do sądu. Teraz natomiast, ponieważ sprawa dotyczyła maksymalnej opłaty, rozstrzygnął już merytorycznie i uznał przepis za niekonstytucyjny.
