W uzasadnieniu wyroku z dnia 15 stycznia 2016 r. w sprawie o sygnaturze akt I CSK 1047/14 Sąd Najwyższy wskazał, że do udzielenia pełnomocnictwa do oddania głosu w imieniu właściciela lokalu na zebraniu właścicieli wspólnoty mieszkaniowej nie jest wymagana forma aktu notarialnego w przypadku, gdy właściciele podejmują uchwałę, dla której ustawa przewiduje taką formę szczególną. Sąd Najwyższy zwrócił uwagę, że choć w art. 99 § 1 k.c. jest ustanowiony wymóg zachowania formy pełnomocnictwa zgodnej z formą podejmowanej czynności prawnej w przypadku, gdy przepis prawa dla tej czynności wymaga formy szczególnej, to nie dotyczy to pełnomocnictwa do oddania głosu w imieniu właściciela lokalu, nawet gdy ustawa przewiduje formę szczególną dla podejmowanej w trybie głosowania uchwały. Oddanie głosu na zebraniu nie stanowi bowiem podjęcia czynności prawnej w formie uchwały, a jedynie zmierza do dokonania tej czynności. Wymóg formy szczególnej pełnomocnictwa zgodnej z formą czynności prawnej zawarty w art. 99 § 1 k.c. dotyczy zaś stricte sytuacji, gdy pełnomocnictwo jest udzielane do dokonania tej czynności prawnej. Głosowanie na zebraniu to czynność odrębna od samej uchwały, a zatem pełnomocnictwo do oddania głosu w imieniu właściciela nie wymaga zachowania formy przewidzianej dla uchwały.
